If My Spouse Remarries Do I Have To Pay Child Support?

October 6, 2018 – Polly Tatum

The effect of your former spouse’s remarriage will not change your duty to pay child support. Child support is the obligation of the parents themselves. New spouses are usually under no legal obligation to help support their stepchildren. Therefore, the non-custodial parent’s child support obligation will not change based upon remarriage alone. However, there are exceptions that may require child support to be modified and vary on a case-by-case basis.
